### **Article 2 – Definitions**
In these General Terms and Conditions of Sale, the following terms shall mean:
– **”The Customer”**: Any individual acting as a consumer who places an order on [www.la-ptite-cerise.be](https://www.la-ptite-cerise.be).
– **”The Seller”**: La P’tite Cerise S.R.L.
– **”The E-store”**: [www.la-ptite-cerise.be](https://www.la-ptite-cerise.be)
– **”The Products”**: The selection of products offered by La P’tite Cerise on the E-store.
– **”The Data”**: The Customer’s personal data including name, surname, address, date of birth, phone number, and email address.
– **”The Cookies”**: Information files automatically stored on the Customer’s computer when visiting the E-store, containing a unique identification number.
### **Article 3 – General Provisions**
These General Terms and Conditions comply with the provisions of the Belgian Economic Law Code.
The Customer expressly acknowledges having read and accepted these Terms before placing an order. Order validation constitutes acceptance of these terms.
These Terms apply to all orders placed on the E-store. Customers under 18 are not allowed to place orders. The Seller reserves the right to request identification when collecting an order.
### **Article 4 – Online Orders**
For the first order, the Customer must complete a form with personal details. A personal client code and password will be assigned. For future orders, only the personal code and password are required.
Order validation implies acceptance of the prices and product descriptions. The Seller reserves the right to accept or refuse any order. The Customer will receive confirmation of order acceptance via an on-screen message.
The Seller may cancel orders it deems fictitious. Until order validation, the Customer may modify or cancel the order directly on the E-store.
### **Article 5 – Prices**
Prices listed on the E-store include all taxes but exclude shipping fees. Prices are in **EUROS (€)**.
The prices payable are those on the order confirmation unless a technical error occurs, for which the Seller is not responsible.
### **Article 6 – Payment**
Payments on the E-store are made securely via **Stripe**, the Seller’s electronic payment partner, ensuring **SSL certification and PCI DSS compliance**.
Accepted payment methods:
– Visa
– Mastercard
– Maestro
– Bancontact
### **Article 7 – Product Availability**
If a product is unavailable, the Seller will notify the Customer. The Seller may offer a **substitute product** of similar quality and price. The Customer may accept or decline the substitution and receive a refund for the unavailable product.
### **Article 8 – Delivery and In-Store Pickup**
Customers can **pick up orders** at: **1330 RIXENSART, Avenue de Mérode 87.**
Orders are shipped via **Bpost**.
**Estimated shipping times:**
– Orders are typically processed within **2 business days** after payment.
– Bpost aims to deliver within **2 business days** after package collection.
– International deliveries take **3 to 6 business days** depending on destination.
**Shipping fees:**
– Calculated during order validation and paid at checkout.
– Includes **preparation, packaging, and shipping costs**.
– Preparation costs are fixed, shipping costs vary based on package weight.
– Bulk order shipping fees may be adjusted by the Seller.
– Separate orders are **not combined** into a single delivery.
**Packaging & Responsibility:**
– Products are properly packed and protected.
– Fragile products receive special attention.
– Parcel size is adjusted to fit the ordered products.
– Delivery is made to the **address provided by the Customer**.
– Address changes or switching from store pickup to home delivery may incur additional transport fees.
– The Seller **is not responsible for shipping delays caused by Bpost**.
– The Seller **is not liable for lost or damaged packages once shipped**.
### **Article 9 – Right of Withdrawal**
Under **Article VI.47 of the Belgian Economic Law Code**, the Customer has **14 days** from delivery to withdraw from the contract for **unopened and unused products**.
The Customer must notify the Seller of withdrawal using the **withdrawal form** attached to these Terms.
Returned products must be in their **original, unopened packaging**. The Customer bears the **return shipping costs**.
The Seller will refund all payments, including initial shipping fees, but may delay reimbursement until the returned products are received.
The Seller is not required to refund extra shipping costs if the Customer chose a **more expensive delivery method**.
Refunds are processed using the **same payment method** unless the Customer agrees to an alternative.
### **Article 10 – GDPR: Privacy Policy**
#### **1. Data Controller:**
The Seller (**La P’tite Cerise S.R.L.**) is the data controller for customer information.

Data is processed **in compliance with Belgian law** and **GDPR (EU Regulation 2016/679).**

Session cookies are **automatically deleted** after browsing, except for language preferences.

The Seller retains data only for the **necessary duration** as per legal obligations.

Customers have the right to **access, correct, and delete their data**.
### **Article 11 – Dispute Resolution**
Customers and the Seller agree to **attempt an amicable resolution** before pursuing legal action.
In case of legal proceedings, **courts in the Seller’s jurisdiction** shall have competence. **Belgian law applies.**
