Article 1 – Seller Information

Opening hours: Tuesday to Saturday, from 10:00 to 18:00

Order processing: Orders are prepared and shipped on business days (Tuesday to Saturday). No shipping is handled on Sundays, Mondays, or public holidays.

Article 2 – Definitions

Customer: Any natural person acting as a consumer and placing an order on the website.
Seller: La P’tite Cerise SRL.
E-store: https://la-ptite-cerise.be
Products: Items offered for sale on the E-store.
Data: Personal information provided by the Customer (name, address, email, etc.).
Cookies: Files automatically stored on the Customer’s device when browsing the E-store.

Article 3 – General Provisions

These terms and conditions are governed by the Belgian Code of Economic Law.
Placing an order implies full and unconditional acceptance of these Terms.
Minors under 18 are not authorised to place orders. The Seller may request proof of identity for collection.

Article 4 – Online Orders

The Customer must provide complete personal information when placing an order.
Validation of the order implies acceptance of the prices, product descriptions, and these terms.
The Seller may cancel any suspicious or fictitious orders.
Orders may be modified or cancelled by the Customer before final confirmation.

Article 5 – Prices

Prices are shown in euros, VAT included, excluding delivery costs.
The price charged is the one in effect at the time of order confirmation, unless a clear pricing error is identified.

Article 6 – Payment

Payments are processed securely via Stripe (SSL certificate, PCI DSS compliant).

Article 7 – Product Availability

If a product is unavailable, the Seller will notify the Customer as soon as possible.
The Customer may accept a similar replacement product or request a refund.

Shipping is limited to Belgium and neighbouring countries:

Delivery prices may vary depending on the carrier’s rates.
The full cost is displayed before final confirmation of the order.

Article 9 – Right of Withdrawal

In accordance with Articles VI.47 to VI.53 of the Belgian Code of Economic Law, the Customer has 14 calendar days from the date of delivery to exercise their right of withdrawal, without having to justify their decision.

Requests may be submitted:

Using the model withdrawal form (see appendix)
Or by any clear and unambiguous written statement

Return Conditions

Products must be returned:

In their original condition
Not used beyond what is necessary to evaluate their characteristics
Preferably in their complete and intact original packaging
With all accessories and documentation provided

Return shipping costs are borne by the Customer, except in the case of an error attributable to the Seller.

In cases of excessive handling resulting in depreciation, a partial refund may be applied (Article VI.51).
Refunds (including standard delivery costs) will be issued within 14 days of receiving the goods or proof of shipment.

Article 10 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

Personalised or custom-made items
Sealed goods opened after delivery (for hygiene reasons)
Perishable goods or items intended for rapid consumption (e.g. freshly roasted coffee)

Article 11 – Legal Guarantee

The Customer benefits from a 2-year legal guarantee of conformity in accordance with Article VI.45 §1, 12° of the Belgian Code of Economic Law.

Article 12 – Data Protection (GDPR)

Customer data is processed in accordance with the GDPR and the Belgian law of 30 July 2018.

Collected data includes:

Data voluntarily submitted by the Customer
Data entered when ordering or browsing the website
Cookies (subject to Customer consent)

Customer Rights:

Access
Rectification
Erasure
Restriction or objection to processing

Some data may be shared with subcontractors strictly for order processing (e.g. delivery or invoicing services).

Article 13 – Disputes

In the event of a dispute, the parties shall first seek an amicable resolution.
If no agreement is reached, only the courts of the Seller’s registered office shall have jurisdiction.
Belgian law applies exclusively.
